Providing Nominal Permit Access to Work

In accordance with the Law № 254 from 09.12.2011, are introduced changes in point C) paragraph (2) Art. 9 and in p. c) and d) paragraph. (2) Art. 10 Labor Legislation of the Republic of Moldova № 154 from 28.01.2003.

According to law, every employer must issue to the employee nominally allowed access at work and employee, in turn, is obliged to wear it all the time. Lack of permit at the employee, shall be punished with a fine for individuals(employees) in the amount from 2000 to 2800 MDL, for persons holding responsible positions in the amount of from 4000 to 7000 MDL and legal entities in the amount from 7000 to 9000 MDL.

Nominal access must contain the following mandatory information:

1. Name of establishment

2. Name and surname of the employee;

3. 3x4 photo;

4. Number and date of the individual employment contract;

5. Function, occupation;

6. Date of issuing the permit;

7. Signature and stamp of the employer.

Also, considering the changes in the Labor Legislation of the Republic of Moldova, the employer during the first month of the beginning of the company activity, then in the first month of each calendar year is required to approve the personnel list of the company and within two months the date of its approval to present (written or electronic), except central and local public authorities one copy of personnel list to the territorial labor inspectorate staff in whose jurisdiction the company was.

Personnel list of company must contain the following information:

1. Number, date, order in accordance with the personnel list was approved;

2. Full name of the company, postal address, tax code / IDNO;

3. Unit names and positions;

4. Number of common units;

5. Salary or wage function (MDL).

On the transfer of a day of vacation in the 2016

In accordance with the provisions of paragraph (5) of Article 111 of the Labor Code of the Republic of Moldova № 154-XV as of 28.03.2003 and in accordance with the Government Decision, No. 867 as of 18.12.2015 shall be considered non-working day: - 7 March.

On the Days of Vacation in the April 2015

In accordance with the provisions of paragraph (1) of Article 111 of the Labor Code of the Republic of Moldova № 154-XV from 28.03.2003, shall be considered non-working holidays: 12, 13 and 20 April 2015

In the attachment bellow, you can find a sample of staff list document. We remind you that under the provisions of lit. c) paragraph 2 of Article 10 of the Labor Code of the Republic of Moldova, in the first month of each calendar year, the company is required to approve the staff of the company and within two months from the date of its approval to represent (in written or electronic form) one copy of the staff list to the territorial labor inspectorate in area of activity where the enterprise is located. If you don’t follow these rules it may result in the imposition of administrative sanctions.

January 1 - New Year;


7 and 8 January - Christmas;
