Regulations on the procedure of applying stamp

The documents of crossing the state border of foreigners are sealed systematically when entering the Republic of Moldova and when leaving it, in accordance with Article 23 of the Law No 215 as of November 4, 2011 on the state border of the Republic of Moldova and the regulations in force.

Printing of the seal is not a proof that was carried out thorough checks made a detailed check. This makes possible to establish the date and place of crossing the state border.

Printing of the seal is also designed to ensure that in the control of entry and exit from the Republic of Moldova to verify if were respected the rule of residence of the foreigners respected by the compliance with the fact foreigner stay in the Republic of Moldova. Thus, the border police apply the seal on documents of crossing the state border which allow foreigners to cross the border, including the mitigation of border control.

Also is applied a seal to the document of crossing the border of the foreigner who has been issued a visa. On optically readable zone of the visa the seal is not affixed.

The entry Seal is affixed on the entry visa to the right side of the visa, and on the leaving –on the left side of the visa. In exceptional cases, at the request of the foreigner and if the stamping of entry and leaving may cause difficulties to the person, printing can be indicated on the certificate of confirmation of the state border of the Republic of Moldova.

In case if the document of crossing the border allows to the foreigner to cross the border, but there is not possible to put a seal, as there are no free pages, a border policeman uses a certificate, on which applies the seal. The certificate is awarded to a foreigner.

At the same time the foreigner is warned to replace the document for crossing the state border.

The certificate contains:

1. name and location of the checkpoint of the state border;

2. date of issue;

3. name and surname of the holder to cross the state border;

4. series and number of the document to cross the border;

5. the stamp border checkpoint;

6. name and signature of the border policeman.

The proof of entry and exit is carried out using a rectangular seal on the entry and the rectangular seal with rounded corners at checkout.

The seal includes at least the following elements: the name of the country "Republic of Moldova", the name of the state border crossing points, the date of crossing the border, the serial number of the seal and an icon indicating the type of border crossing points (road, air, rail or river).

Regulations to establish procedures for refusal of entry to the Republic of Moldova and for leaving it

If the border police decides to refuse entry or leaving from the Republic of Moldova in accordance with the Law No 200 as of 16 July 2010 on the status of foreigners in the Republic of Moldova, the Law No 215 as of November 4, 2011 on the state border of the Republic of Moldova and the regulations in force.

In this case, the border police fill a standard form to refuse entry to the Republic of Moldova in accordance with the template or standard form of refusal to depart from the Republic of Moldova in accordance with the sample.

The person, to who was applied the measure of refusing entry or leaving Republic of Moldova, signes the form and receives a copy of the signed form.

If the person refuses to sign the form, border police state indicates the reasons of refusal on the form in the "Comments" and gives a copy to the person to whom the measure was applied.

In case of refusal of entry to the Republic of Moldova in the passport will be sealed with the cross in black ink that can not be erased and is writing near it, on the right also written with ink that cannot be erased, the letter / letters corresponding of reason / reasons for the denial of entry.

List of letters, reasons of refusal of entry is presented in a standard form for the refusal of entry to the Republic of Moldova in accordance with the sample.

Also a border policeman cancels visa by stamping with a record "ANULAT" in accordance with the regulations on visas. In this case, the optical elements of the liner visas, respectively, "the effect of hidden image", and the term "visa" marked with a cross to prevent any further use of visas for illegal purposes. Border police immediately inform the Ministry of Foreign Affairs and European Integration and the competent authority of Immigration to cancel the visa.

A visa is canceled in accordance with the regulations in force, and in the following situations:

a) the foreigner has received a visa on the basis of false documents or information;

b) the foreigner has imported or attempted to smuggle into the Republic of Moldova of other foreigners facilitated their transport or accommodation;

c) the foreigner has violated customs regulations or the rules of crossing the state border;

d) the foreigner no longer meets the conditions for a visa;

e) are not complied with the purpose for which was granted a visa;

f) after according the visa the foreigner has been declared as an undesirable person.

A foreigner who has been refused entry to the Republic of Moldova should be informed of the resolution adopted in a language he understands. A foreigner, who demands the right to asylum or international protection, cannot be denied entry to the Republic of Moldova.

Order of the Chief of the Border Police regarding the implementation of the Law No 215 as of 04.11, 2011 law on the state border of the Republic of Moldova No 121 as of 08.11.2012 published in Monitorul Oficial No 242-244 as of 23.11.2012.

The Order comes into force from the date of publication.
