The Changes to the Guaranteed Minimum Wage in Real Sector

In accordance with the provisions of the article 12 of the law on salaries No. 847-XV as of February 14, 2002, which stipulates that, the guaranteed minimum wage in real sector is reviewed annually depending on the total annual increase of the consumer price index and the rate in the labor productivity at the national level, were made changes to paragraph 1 of the Government Decision No. 165 as of March 9, 2010 "on the guaranteed minimum wage in real sector."

The words "May 1, 2012" were replaced by the words "May 1, 2013" and the numbers "7.70" and "1300" are replaced by "8.28" and "1400".

Thus, in accordance with the made changes, the guaranteed minimum wage in real sector starting with May 1, 2013 will constitute 8.28 Lei per hour or 1400 Lei per month, calculated from the average working hours 169 hours per month.

In the case of application by enterprises, the wage tariff system or in the case of application of the wage tariff-free system, the total monthly wage of one employee may not be lower than the guaranteed minimum wage in real sector, established by the Government after consultation with the social partners.

Simultaneously with the establishment of the minimum wage in real sector, previously established basic salary shall be reduced, only in accordance with the paragraph (2) of the article 20 of the Law on salaries No. 847-XV as of February 14, 2002, which stipulates that, the reduction of the wages under collective or individual labor contracts, may be made at the request of the Contracting Parties only upon the expiry of the collective agreement but not before one year from the date of their establishment.

In accordance with the provisions of paragraph (5) of Article 111 of the Labor Code of the Republic of Moldova № 154-XV as of 28.03.2003 and in accordance with the Government Decision, No. 867 as of 18.12.2015 shall be considered non-working day: - 7 March.
