Government Decision Concerning Food Additives Regulation

On the basis of Articles 6 and 72 of the Law No. 10-XVI as of 03. 02. 2009 on State Supervision of Public Health, Article 9 of the Law No. 78-XV as of 18.03.2004 on food, the Law No. 422-XVI as of 22.12.2006 on general product safety, as well as to ensure a high level of protection of public health government approved sanitary regulations for food additives.

Health regulation on food additives (hereinafter - Regulations) creates a framework necessary for the application of Regulation (EC) № 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives, published in Official Journal L 354 of 31 December 2008 , with subsequent amendments and additions.

Regulation provides:

  • - national list of food additives permitted for use in foods and conditions of use;
  • - National List of food additives, including carrier substances permitted for use in food additives, food enzymes, food flavorings and nutrients and their conditions of use;
  • - list of food dyes for which food labels include additional information;
  • - conditions of use of food additives in foods, including food additives, food enzymes and food flavorings;
  • - rules of labeling food additives sold as such.

The Regulation, the definitions set out in the Law No. 78 as of 18.04. 2004 on food, and also introduces new terms (dietary supplement, functional class, the food product without the addition of sugars, tabletop sweeteners, quantum satis).

The Regulation also establishes a list of substances which are not food additives.

Regulation shall apply without prejudice to any special national rules concerning the use of food additives:

  • a) specific foods;
  • b) for other purposes, except as provided by the Regulations.

Only food additives included in the national list of food additives permitted for use in foods and their conditions of use in accordance with Annex № 1 to this Regulation may be placed on the market as such and used in foods under the conditions specified in this list.

Only food additives included in the national list of food additives, including carrier substances permitted for use in food additives, food enzymes, food flavorings and nutrients and their conditions of use in accordance with Annex № 2 to the present, can be used in food additives, food enzymes and food flavorings in the conditions provided for in this list.

Regulation (paragraph 9) contains functional classes of food additives in foods and food additives in food additives and food enzymes.

Food additives must comply with the specifications concerning, in particular, the origin, purity criteria and any other relevant information, should be taken if a food additive for the first time included in the national lists.

Nutritional supplements are not intended for sale to the end user, regardless of their implementation individually or in admixture with each other and / or with food ingredients can be realized only with labels listed in paragraph 43 of the Rules that need to be visible and readable indelible. This information is presented in terms understandable to customers.

If nutritional supplements are not intended for sale to the final consumer are sold singly or mixed with each other and / or other components of the food and / or with other substances added to them, to their packaging or containers specifies the information that is given in paragraph 43 of the Regulations.

Labels table sweetener containing polyols and / or aspartame and / or aspartame-acesulfame salt, shall contain the following warnings:

  • a) polyols: "excessive consumption may have a laxative effect;"
  • b) aspartame / aspartame-acesulfame salt: "contains a source of phenylalanine."

Label food products made using food additives must be approved by the Ministry of Health - Public Service of Public Health Supervision.

The manufacturer or user of food additives informs the Ministry of Health, at its request, on the actual use of the additive.

The Decision comes into force after six months from its publishing. Date of entry into force: 05.10.2013.
